Overview
These Terms of Service ("Terms") govern your use of the TradeTaxPro.com website ("Site") operated by Book More Jobs, LLC d/b/a Trade Tax Pro ("Trade Tax Pro," "we," "us," or "our"). By accessing or using this Site, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you may not access or use the Site.
These Terms apply to all visitors, users, and others who access or use the Site. They do not constitute a client-attorney or client-accountant relationship.
Services Description
Trade Tax Pro provides tax return preparation, quarterly estimated tax filing, and related tax compliance services for independent contractors, freelancers, and small businesses in the trades and construction industries.
Tax laws are complex and change frequently. While our licensed tax professionals stay current on relevant tax law, we cannot guarantee that information on this Site is complete, accurate, or up-to-date at any given moment.
Circular 230 Disclosure: To ensure compliance with Treasury Department regulations governing the practice of tax professionals before the Internal Revenue Service, we inform you that any tax advice contained in any communication on this Site is not intended to be used, and cannot be used, for the purpose of (i) avoiding tax-related penalties under the Internal Revenue Code, or (ii) promoting, marketing, or recommending to another person any transaction or tax-related matter.
Client Engagement
A client relationship with Trade Tax Pro is established only when:
- You have received, reviewed, and signed a written Engagement Letter
- We have confirmed acceptance of your engagement in writing
- Any required engagement fee or deposit has been received
Submitting a contact form, scheduling a consultation, or providing information on this Site does not create a client relationship or obligate Trade Tax Pro to provide services. We reserve the right to decline any engagement at our sole discretion.
The scope of services, fees, deadlines, and other material terms of any engagement will be set forth in your Engagement Letter. The Engagement Letter, and not these Terms, governs the actual tax preparation services provided to you.
Client Responsibilities
By engaging our services, you agree to:
- Provide accurate and complete information: You are responsible for the accuracy and completeness of all information you provide to us. Trade Tax Pro relies on information you provide and does not independently verify it.
- Retain supporting documentation: You are responsible for maintaining original supporting documents for all items reported on your tax return (receipts, statements, mileage logs, etc.).
- Timely communication: You agree to respond to requests for information in a timely manner to allow for accurate and on-time filing.
- Review before signing: You are responsible for reviewing your completed tax return before it is filed. By signing the return, you confirm that it is accurate and complete to the best of your knowledge.
- Notify us of changes: You agree to promptly notify us of any material changes in your circumstances (new business, significant income changes, IRS correspondence, etc.).
Amendment Policy
Trade Tax Pro stands behind the quality of our work. If we make an error in preparing your return that results in a penalty or interest charge from the IRS or state tax authority, we will work with you to assess the error and, where our error caused the penalty, prepare any required amended returns at no additional charge for the preparation fee.
Any IRS penalty or interest amounts remain your responsibility. Our amendment policy covers preparation fees only, not taxes owed, penalties, or interest assessed by tax authorities. This amendment policy is not a guarantee of any particular tax outcome.
Limitation of Liability
To the fullest extent permitted by applicable law, Trade Tax Pro, its members, managers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or our services, including but not limited to loss of profits, data, business, or goodwill.
Our total aggregate liability to you for any claim arising from or relating to these Terms or our services shall not exceed the greater of: (a) the total fees you paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Intellectual Property
The Site and its original content, features, and functionality are owned by Book More Jobs, LLC d/b/a Trade Tax Pro and are protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from this Site without our express written permission.
Any tax planning frameworks, worksheets, checklists, or other materials we provide to you as part of our services are for your personal use only and may not be redistributed or resold.
Electronic Communications
By using this Site or contacting us, you consent to receive electronic communications from us. These communications may include:
- Responses to your inquiries
- Appointment confirmations and reminders
- Tax deadline reminders and informational updates
- Service-related announcements
You agree that any notices, agreements, disclosures, or other communications we send electronically satisfy any legal requirement that such communications be in writing.
You may opt out of non-essential marketing communications at any time by clicking the unsubscribe link in any email or by contacting us directly.
Dispute Resolution
Informal Resolution: Before filing any formal claim, you agree to first contact us to attempt to resolve the dispute informally. Most disputes can be resolved promptly through direct communication.
Binding Arbitration: If informal resolution is unsuccessful, any dispute arising from or relating to these Terms or our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Austin, Texas.
Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis, not as a class, collective, or representative action.
Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without giving effect to any conflict of law principles. To the extent litigation is permitted, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Williamson County, Texas.
Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be communicated via email to clients with active engagements.
Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.
